Delhi High Court Dismisses Petition Seeking CBI Investigation into BitBNS

The Delhi High Court has made a significant decision regarding the regulation of cryptocurrency exchanges in India. A petition seeking the establishment of a regulatory framework and policies for overseeing such exchanges, as well as a Special Investigation Team (SIT) under the Central Bureau of Investigation (CBI), was dismissed by the court.

In its ruling, the High Court stated that there was no sufficient material on record to warrant the constitution of an SIT. The court also emphasized that cryptocurrency exchanges are private entities and do not qualify as 'State' under constitutional law.

The petition had requested directions to various government agencies, including SEBI, the Union of India, and the Ministry of Finance, to establish a regulatory framework for cryptocurrency exchanges and transactions. However, the High Court ruled that it cannot create new regulations or order investigations without proper legal authority.
