Hawkins County Crypto Mining Ban Challenged in Federal Lawsuit
A lawsuit has been filed by the Beacon Center of Tennessee against Hawkins County, challenging a recent resolution to ban data centers and cryptocurrency mining operations in the county.
The resolution, passed on September 22nd, stated that the centers require massive amounts of electrical energy, produce continuous noise, and create no sustainable economic benefit to local communities. However, the lawsuit argues that this ban is 'arbitrary and unreasonable' and does not distinguish between data centers that draw energy from the existing grid and those that are self-sufficient.
The lawsuit also claims that Hawkins County's actions violate state law by preventing property owners from using their land for productive purposes. According to the lawsuit, Tennessee counties have no inherent powers to regulate private property and land use, and any zoning regulations must be adopted in accordance with the County Powers Act.
