Senate Racing Clock on Crypto Clarity Bill Ahead of Recess
The US Senate has only 15 days to pass the Crypto Clarity Act before its August recess, which is expected to begin on August 10, 2026. The bill, formally designated H.R. 3633, aims to draw a clear line between digital commodities and securities, with commodities falling under CFTC jurisdiction and securities staying with the SEC.
The legislation also addresses market structure, disclosure requirements, and consumer protections, which have been left uncertain due to the current patchwork of state-level rules and federal guidance. The bill has already passed the House with a 294-134 bipartisan vote in July 2025 and was approved by the Senate Banking Committee on May 14, 2026.
Senators Cynthia Lummis and Tim Scott are key negotiators shepherding the bill toward a floor vote. Updated bill text is expected by late July 2026, suggesting final language is still being hammered out. The bill's passage could lead to a structural shift in how new projects design their token economics.
