Aave Secures Court Victory Over Frozen Ethereum Funds
A federal judge has delivered a significant blow to North Korea's Lazarus Group, clearing the way for Aave LLC to transfer $71 million in frozen Ethereum (ETH) from Arbitrum to an Aave-controlled wallet. U.S. District Judge Margaret Garnett of the Southern District of New York issued a two-page order modifying a restraining notice filed by creditors holding $877 million in unpaid claims against North Korea.
The judge's ruling shields anyone who initiates, votes on, or participates in the transfer from personal liability under the notice. Aave's core argument carried the day, with the company successfully asserting that the funds belong to innocent protocol users, not to the hackers or North Korea.
