Aave Seeks Release of Frozen Ethereum from Kelp DAO Breach

Aave, a leading decentralized finance (DeFi) protocol, has submitted an emergency legal filing to release approximately $73 million in frozen Ethereum from the Kelp DAO breach. The funds were seized by a law firm representing clients with court judgments against North Korea, which allegedly linked to the hackers involved in the incident.

Aave's lawyers argue that the assets do not belong to North Korea or its affiliates and should be returned to affected users. They contend that stolen assets cannot legally transfer ownership to thieves, as stated by Stani Kulechov, Aave's founder. The company warns that continued delays in releasing the funds could inflict 'irreparable harm' on the protocol infrastructure and its user base.

The incident occurred on April 18 when a vulnerability in the Kelp DAO rsETH token system was exploited, resulting in the theft of approximately $230 million in Ether from Aave platform users. The Arbitrum protocol intercepted 30,766 ETH and sequestered it for victim restitution, with a current value near $73 million.

A collective initiative, 'DeFi United,' has accumulated over $327 million to compensate rsETH token holders through the sector-wide collaborative effort. However, Aave maintains that the restraining order jeopardizes the entire recovery operation and requests that Gerstein Harrow provide a $300 million bond if the court declines to remove the freeze.
