Gary Gensler's Alleged Apology to Ripple CEO Sparks Regulatory Shift
The Ripple vs. SEC lawsuit has been one of the most contentious legal battles in the cryptocurrency industry. At its core, the dispute revolves around whether Ripple's XRP token is a security or a currency. In December 2020, the SEC filed a lawsuit against Ripple Labs, Brad Garlinghouse, and Chris Larsen, alleging that XRP was an unregistered security offering.
However, in July 2023, Judge Analisa Torres delivered a partial summary judgment, ruling that programmatic sales of XRP on exchanges were not securities offerings. Nevertheless, she found that institutional sales of XRP by Ripple did violate securities law.
The alleged apology by Gary Gensler to Brad Garlinghouse is significant because it suggests a recognition of the case's complexity and its impact on the industry. A personal apology from the former SEC Chairman would be unprecedented in this context, potentially marking a shift away from aggressive enforcement.
