Kraken Parent Sues Etana Custody Over Alleged $25M Fraud

Kraken's parent company, Payward, has escalated its federal lawsuit against Etana Custody, a global custody service provider. In a second amended complaint filed on May 4, Payward accuses Etana and CEO Dion Brandon Russell of fraud, civil theft, commingling, false account statements, and improper use of customer reserve funds.

The dispute revolves around Etana's ability to return customer assets when demanded. Payward alleges that Etana displayed balances as though funds were secure while lacking the liquidity to return approximately $25 million when Kraken sought withdrawal. This is not a simple payment delay but an attack on the integrity of Etana's custody model and account-balance information.
