The complaint, filed in federal court, claims that Pudgy Penguins' use of the penguin word and design marks could mislead consumers into believing they are connected to PEI. This is not the first time Pudgy Penguins has received a cease-and-desist order from PEI, as it received one in October 2023.

Pudgy Penguins has been expanding its presence in various markets, including consumer finance and retail. The NFT brand unveiled a cryptocurrency debit card, powered by Visa Inc., which allows users to spend stablecoins or cryptocurrencies directly at over 150 million merchants.
