SEC Commissioner Hester Peirce Advocates for Blockchain Developers' Protections
SEC Commissioner Hester Peirce has continued her advocacy for clearer, more tailored rules for the crypto sector, emphasizing the need to distinguish between publishing open-source code and engaging in securities transactions. In a recent speech at the IC3 Blockchain Camp hosted by Princeton University, Peirce highlighted the risks of applying traditional financial rules to decentralized technologies.
She noted that liability for securities law violations should lie with those engaging in unlawful conduct, not the developers who create the underlying technology. This distinction is critical amid growing debates over how decentralized finance (DeFi) platforms should be regulated.
The SEC's Crypto Task Force, led by Peirce since 2025, has sought to clarify the application of securities laws to digital assets and move away from enforcement actions. The agency's draft Strategic Plan through 2030 identifies digital assets as transformative technologies that could reshape financial markets.
