OG Takes On Washington Over Kalshi-Inspired Enforcement Threat

Crypto.com's prediction market platform, OG, has filed a federal lawsuit against the State of Washington in an effort to block potential enforcement actions. The company claims that a recent court ruling against Kalshi and public statements from state officials demonstrate an imminent threat that regulators will pursue similar claims against its federally regulated exchange.

The lawsuit was filed on July 22, two days after the Kalshi ruling, which found Washington likely to succeed in its claims that Kalshi's event contracts violate state gambling laws. The court also rejected the operator's federal preemption arguments.

OG argues that the CFTC's recent intervention in Michigan demonstrates how state-by-state enforcement conflicts with the federal regulatory framework governing designated contract markets. The company is seeking a declaration from the federal court that Washington's enforcement efforts are unlawful and to permanently prohibit state officials from pursuing similar actions against OG or its event contracts.
