SEC Stance on Crypto Shifts, Airdrop Lawsuit Dropped by Beba and DeFi Education Fund
A recent development in the cryptocurrency regulatory landscape has seen a lawsuit against the US Securities and Exchange Commission (SEC) dropped by a Texas-based apparel company and the DeFi Education Fund.
The voluntary dismissal, filed in the US District Court for the Western District of Texas on Friday, cites the SEC's shift in stance towards crypto. Specifically, Commissioner Hester Peirce's statements in several speeches last year suggesting that airdropped tokens are not securities have been highlighted as a key factor in this decision.
The lawsuit had alleged that the regulator adopted its digital asset enforcement policy without following the formal notice-and-comment rulemaking process required under the Administrative Procedure Act.
