Aave Secures Court Approval for $71 Million Frozen Ether Recovery
A key decision has been made in the ongoing case of Aave's recovery efforts. The company had been trying to regain control of $71 million in frozen ether from Arbitrum, which is linked to a major exploit.
The Manhattan federal judge's ruling allows Aave to transfer the funds to a wallet controlled by Aave LLC while also protecting participants from legal liability if they assist with the transfer. This decision balances Aave's need to recover its assets with ongoing legal pursuits by terrorism judgment creditors.
Attorney Charles Gerstein, representing families with large unpaid judgments against North Korea, had argued that the frozen ether could be seized due to its strong link to the Lazarus Group, a state-sponsored hacking entity. However, the court order finds a balance between Aave's recovery efforts and the pursuit of North Korean-linked assets on DeFi platforms.
