The Digital Asset Market Clarity Act seeks to draw a distinction between digital asset securities and digital commodities, with the Securities and Exchange Commission (SEC) overseeing investment contracts resembling traditional securities, while the Commodity Futures Trading Commission (CFTC) would supervise decentralized network tokens and digital commodities.
This clarification is crucial as regulators and courts have struggled for years to decide which agency should oversee specific digital assets, leading to uncertainty, lawsuits, and uneven compliance rules.
