Aave Seeks to Lift Restraining Order on Frozen Ethereum Assets
Aave, a decentralized finance (DeFi) platform, has filed an emergency motion with a New York federal judge to lift a restraining order on $71 million in Ethereum. The funds were frozen by the Arbitrum community as part of efforts to return them to victims of a recent exploit.
The plaintiffs suing North Korea claim that the hacker's brief possession makes the assets theirs now, but Aave argues that this is not the case. According to Aave, the assets belonged to its users before the theft and were recovered to be returned to those who lost money in the April 18 hack.
Aave has asked the court for an expedited hearing and a temporary vacatur of the restraining notice pending resolution of the matter. If the court declines immediate relief, Aave has requested that plaintiffs be required to post a cash bond of at least $300 million to cover the potential damages caused by the freeze.
